Terms and Conditions

1. General Information

This document governs the terms and conditions for using the pixystudio.ro website, as well as the contractual conditions applicable to services provided by PixyStudio.

2. Services Provided

PixyStudio provides website creation, maintenance, and webpage management services.

Prices are listed in euros and do not include VAT, as PixyStudio is not VAT-registered. Invoicing is done in RON, at the BNR EUR/RON exchange rate on the day the invoice is issued.

3. Order and Contract

The collaboration begins by sending a message through the contact form or email. After the client confirms the offer, a service agreement is sent. The contract is considered concluded once it is signed and the deposit is paid.

The standard deposit is 30%, with the remaining balance due upon project completion.

4. Delivery Timelines

• Landing Page: 5–7 business days
• Business Website: 7–14 business days
• Premium Website: 14–21 business days

Timelines start after all materials have been received from the client.

5. Ownership and Licensing Rights

The code structure (HTML, CSS, JS, React/Next.js components), the overall visual layout, and the structural graphic elements developed by PixyStudio remain the exclusive intellectual property of our studio.

Upon full payment for the project, the client receives an unlimited-term license to use the website, strictly for the commercial purposes of their business. The client may not resell, duplicate, or distribute the code structure or website design to third parties.

All materials provided by the client (logo, personal images, brand-specific text) remain their exclusive property.

PixyStudio reserves the right to include the completed project in its online portfolio. The technologies used (Next.js, React, etc.) remain under their respective open-source licenses.

6. Warranty and Changes

A 30-day warranty is provided for technical errors.

Subsequent changes are considered separate services.

7. Limitation of Liability

PixyStudio facilitates the relationship with hosting providers, but is not responsible for server downtime, domain expiration due to the client's fault, or security breaches of hosting platforms.

PixyStudio is not liable for indirect losses, content provided by the client, or issues caused by third parties (hosting, domain).

8. Changes to These Terms

We reserve the right to modify these terms at any time. The updated version will be published on the website.

9. Project Cancellation

Under Romanian law (OUG 34/2014), customized services (such as web design carried out according to the client's specifications) are exempt from the right of withdrawal once the service has begun with the client's prior express consent.

The client may request cancellation of the project, but the deposit is non-refundable.

If the project is discontinued by PixyStudio, the amount will be refunded proportionally.

10. Governing Law

This document is governed by Romanian law. Disputes will be resolved by the competent courts of Romania.
